chooses Tampa as its site to hold an annual 3 day convention. Each office arranges with their local transportation service to drive the employees into Tampa & for transport back home after the 3 day event. As soon as the limousines carrying these Tampa bound folks crosses Hillsborough County lines the Driver's are subject to arrest pursuant to the provisions set forth in Florida Law

Chapter 2001-299 Laws Of Florida

"In addition to any civil penalties contained elsewhere in this act, any person who violates or fails to comply with or who procures, aids, or abets in the violation of any provision of this afct or any rules adopted in accordance with this is guilty of a criminal offense and misdemeanor"   

"Any person who operates a public vehicle upon the public highways without a Certificate, Permit or Public Vehicle Driver's License as provided by this act and any rules adopted in accordance with this act ........ may be enjoined by the courts of this state from any such violation"

 


 

 

Fact

The HCPTC is mandated by its' enabling legislation ch 2001-299 to enact Rules in conformance with ch 120 Florida Statutes, the Administrative Procedure Act

The Florida Legislature placed into law the definition of a limousine as "any" vehicle with a capacity for 15 passsengers or less not equipped with a taximeter. The HCPTC in its' rules and enforcement changed the legislative definition & has restricted the primary prearranged transportation for the interstate transportation hubs to luxury class vehicles and in doing so has imposed additional operating costs on the motor carriers which are passed onto the traveling consumer.

 

Under ch 120 F.S. an agency rule is deemed to be an invalid excercise of delegated legislative authority if the rule enlarges or modifies the specific provision of law or if that rule imposes regulatory costs on the regulated person.
