If Chapter 2001-299 does not expressly authorize the HCPTC to implement a regulatory measure, it is not within their scope of powers.       

 

"It is unlawful for any person to engage in the business of operating a public vehicle on the public highways of the county unless that peron has complied with the provisions of this act and any rules adopted in accordance with this act."

 

"Any person desiring to engage in the business of operating any public vehicle in the county must first acquire a certificate from the commission and must first make written application to the commission on a form provided by the commission for that purpose." 

 

"A person operating a public vehicle in the county or any of its municipalities must have a public vehicle driver's license and a driver's license issued by the State of Florida valid for the type of public vehicle for which a public vehicle driver's license is sought."

The Interpretation Of The Law By The HCPTC

  • A non-HCPTC licensed motor carrier may transport passengers into Hillsborough & so long as the vehicle remains with the passengers, the motor carrier may stay in the county for an indefinite amount of time.
  • A non-HCPTC licensed motor carrier may transport passengers into the county & discharge them at the transportation hubs (airport & cruise ship terminals).
  • A non-HCPTC licensed motor carrier may load the passenger who hired the transportation service outside the boundaries of the county, enter the county, then load the rest of the passengers.

 

 What A Non-Licensed Motor Carrier May Not Do

  • A non-HCPTC licensed motor carrier may not discharge passengers at a transportation hub then return to load the same passengers at a later date for transfer back to home county.
  • A non-HCPTC motor carrier may not discharge passengers attending a multiple day event then return to load the passengers for transport back home.
  • Consumers utilizing a non-HCPTC licensed motor carrier attending tour attractions in Hillsborough/Tampa must pay the motor carrier to sit in a parking lot for the 8 - 12 hours they are at the attraction.
